Haryana: issue a Section 108 direction and announce that Eleven Power will not distribute in parallel
Draft policy direction against the HERC order of 19 October 2026 in Petition No. 30 of 2026. Eleven Power has filed a caveat before APTEL.
To: Chief Minister, Government of Haryana, Chandigarh
The National Centre has written to the Chief Minister of Haryana. The government is in dialogue with the employees and engineers, and has indicated that it is ready to issue a policy direction under Section 108 of the Electricity Act, 2003, while also appealing against the 25-year parallel distribution licence granted to Eleven Power Private Limited for Gurugram and Nuh.
Eleven Power filed a caveat before the Appellate Tribunal for Electricity on 21 October 2026. It names the state utilities, EEFI and other objectors as expected appellants, and asks that no interim order be passed without notice to the company. The appeal therefore has to be filed promptly, a stay sought, and a clear Section 108 direction placed on the record.
The letter recalls Karnataka, where a public stand by the Chief Minister and the Cabinet against private distribution led Tata Power to withdraw its applications, and Maharashtra, where the government said it did not support privatisation and would oppose parallel licensing.
EEFI asks the government to issue the enclosed draft direction without delay; to have the Chief Minister announce that parallel licensing is not the policy of Haryana and that Eleven Power will not be permitted to distribute in parallel in the state; to pursue the appeal, seek a stay, and place the direction on record; and to give no right-of-way, land or clearance for a parallel network or for consumer migration while the appeal and the direction are pending.
The draft direction states that parallel licensing is not in the public interest, and that distribution shall continue through the existing public utilities. The Commission is to be guided by that policy on the Eleven Power licence and on any further parallel licence. No step that builds a parallel network or migrates consumers is to cut against the policy while the appeal is pending.
